Terms & Conditions Agreement

PK Plumbing Ltd - Subcontractor Agreement (Summary)

Payment: 50/50 labour split on completed jobs
Equipment: You provide your own tools and van
Insurance: £2M+ public liability required

SUBCONTRACTOR AGREEMENT

Between PK Plumbing Ltd and Independent Contractor

1. Parties to the Agreement

This agreement is between:

PK Plumbing Ltd ("we", "us", or "the Company")

and

You, the subcontractor ("you" or "the Subcontractor"), acting as an independent contractor.

By accepting these terms, you confirm that you are operating as a sole trader or registered company and are authorised to enter into this agreement.

2. Independent Contractor Status

You are engaged as an independent contractor. Nothing in this Agreement shall render you an employee, worker, agent, or partner of the Company.

You shall have full control over how the Services are performed and shall use your own judgment as to the most effective and efficient manner of delivery.

You are not entitled to any employee benefits from the Company such as holiday pay, sick pay, pension contributions, or insurance.

As an independent contractor, you assume full and complete responsibility for all aspects of your work, including work quality, timeliness, safety practices, property damage, customer interactions, and adherence to regulations. The Company bears no responsibility for your actions or omissions while performing Services.

3. Services and Scope of Work

The Services to be provided under this Agreement consist of:

Plumbing reactive repairs and maintenance (domestic and commercial)
Drainage work (internal and external)
Gas boiler servicing, diagnostics, repairs, and installations
Gas pipework (repairs, alterations, installations)
General plumbing and appliance work

11. Customer Relationship & Non-Solicitation

During the term of this Agreement and for 12 months after its termination, you must not, without our prior written consent:

Approach, quote, or accept work directly from any customer introduced to you by us
Give out personal contact details, promote your own services, or redirect work to yourself or another party
Solicit or entice away from the Company any person who is or was an employee or key contractor of the Company

Any follow-up work, referrals, or additional jobs arising from PK Plumbing customers must go through PK Plumbing Ltd, even if the customer requests you directly.

Where we believe work has been completed privately between you and a client introduced through us, we reserve the right to reclaim our usual share of the labour value. In such cases, we also reserve the right to withhold payment for other unrelated works where concerns exist regarding adherence to this clause.

This clause is not intended to be punitive, but rather to maintain integrity, fairness, and trust in all client and subcontractor relationships.

9. Fees and Payment

Labour is paid on a 50/50 split basis, unless otherwise agreed in writing. You will receive 50% of the labour value (excluding VAT) from the final invoice paid by the customer.

Payment to subcontractors is contingent upon customer payment to PK Plumbing Ltd. We reserve the right to withhold or adjust payments if client settlement issues arise.
